The
profession of a lawyer is one of the most popular professions among
young people in our country. In our country a lawyer should play a
very important role in process of building a rule-of-law state.
Graduates from different law schools can work at the Bar, in the
organs of the Prosecutors Office, in courts, in notary offices, in
organs of police… They can work as advocates, prosecutors, judges,
notaries… A lawyer should now many laws and them proper
application. So that would be lawyers study many important subjects
such as theory of state and law, Civil law, Criminal law,
Administration law, Civil procedure and other. Besides, any lawyer is
expected to know human psychology because all of us will meet
different people with unique characteristic. Quite
a lot of the graduates from our Academy work as investigator. The
duty of an investigator is to search for the truth, for the offender,
for witnesses, to help to reconstruct the happening. Investigators
find project evidence (foot-, fingerprints). For that purpose they
use special means of investigative technique. Then the duty of the
investigator is to examine all the evidence to establish proof of
guilty. Every investigator knows that the success of investigation
depends on his efforts, his abilities. Some lawyers may also work as
detectives. The activity of detective includes event and covert
functions. The quick solution of crime depends largely on the
personal efforts. An integral part of the detective activity is his
undercover work. But
the most of our graduates work in Prosecutors offices. The PO was
established in our country in May 1922. It’s a system of bodies
exercising general supervision over the strict and uniform observance
of laws by all the ministers, organization and by citizen. Its tasks
are also strengthening legality and law and order as well as
protection personal rights and freedom of citizens. Any citizen can
complain to the PO against violation of his/her freedom. No person
may be arrested without an order a public prosecutor or a court. In
performing their duties prosecutors must be free and independent of
any local bodies. That’s why public prosecutors are appointed and
not elected and they appointed for a term of 5 years. Prosecutors –
person not younger than 25 years old, who has the higher legal
education and possesses necessary moral qualities. The PO institutes
criminal proceedings. The public prosecutor brings a charge before
the court in the name of state. At the trial his task is to assist
the court to pass just sentence. After the trial public prosecutor
checks the legality sentences and judgments. So
the legal profession in the Russia is very interesting and diverse
and quite necessary for regulating society’s life in the state.

Topic “Legal profession in UK” England
is unique in having two different kinds of lawyers. They are
solicitors and barristers. If a person has a legal problem, he goes
to see a solicitor. Almost every town has at least one. In fact,
there are about 60,000 solicitors in Britain. Many problems are dealt
with exclusively by a solicitor. For instance, the solicitor deals
with petty crimes and some matrimonial matters in MC. He prepares the
case and evidence. He may represent his client in the lower courts.
In a civil action, he can speak in the county court, when the case is
one of divorce or recovering some debts. Barristers are
different from solicitors. Barristers are experts in interpretation
of the law and advocacy. They advice on really difficult points, and
conduct legal proceedings in the higher courts. Their work includes
presenting evidence, making submissions on behalf of their clients,
representing parties in criminal trials, dealing with civil claims
for damages. Barristers have an exclusive right of audience in the
High Court and the Court of Appeal. There are about 6,000 barristers
in England. In Britain, the vast majority of judges are
unpaid. They are called JPs. They are ordinary citizens who are
selected not because they have any legal training but because they
have “common sense” and understand their fellow human beings.
They work voluntary. A case is usually heard a bench of three JPs who
are advised on the law by clerk of the court. There are about 30,000
magistrates and they hear over 90% of criminal cases. A small
proportion of judges are not magistrates. They are trained lawyer,
nearly always ex-barristers, who sit in the Crown Court and Appeal
Court. The judge rules on points of law, and makes sure that the
trial is conducted properly.

The main tasks of the criminal legislation of virtually all the countries consist in the protection of
the criminal legal means against criminal encroachments of the personality, rights and freedoms
of citizens, state and public interests, property, and the rule of law in the country.
The criminal law of England is developing, through the issuance of new consolidated acts, or
acts of, making changes in the previously issued by the statutes. The regulation of the rights of
property in the country is carried out on the basis of the Law about the theft of 1968, the law «on
wrongful damage to» 1971, and the law «about the theft», 1978. These laws provide for the
following basic types of criminal offences against property: theft, robbery, burglary, obtaining
property by deception, extortion, the crimes connected with stolen property, different types of
criminal
fraud.
The sources of the criminal procedure law in England are first of all legislative acts, for the most
part at the same time regulating and issues of the judicial system. Among them are laws on the
Supreme court 1981, the magistrates courts 1980, the jury 1974 (with subsequent amendments),
on appeal in criminal matters 1968, as well as the laws on criminal justice 1925 and a number of
subsequent years, including the law of 1988. Among the instruments that were published in the
last decade, of great importance is the Law on the prosecution of crimes 1985, The law on the
administration of justice 1985 and especially the Law on police and evidence in criminal cases
1984. (in detail regulates the activities of the police for the investigation of crimes, including
issues associated with the production of searches and arrests, preliminary detention of the
accused and the consideration of complaints on the actions of the police during the investigation,
as well as the assessment of certain evidence, in particular received with the help of computer
devices).
With regard to case law, and in criminal proceedings, despite the abundance of legislative acts,
their role is still very significant: it is in the interpretation of the provisions in the General form
laid down in separate legislation, and to address gaps in the legislation. The legal Commission,
which submitted in 1989 the draft criminal code for England and Wales offers in the future, after
approval in principle projects of General and Special parts of the criminal code, to develop as the
third part of the same code section called the «Evidence and procedure», i.e., in essence, the
procedural part of the General criminal and criminal procedure codes. However, the preparation
of this section has not started yet. Sources of the civil procedural law in England are first of all
the legislative acts of the nature, which determine the structure, competence, and some issues of
the activity of courts of different levels (the Law on the Supreme court 1981, The law on courts
counties 1984,
Important role in the regulation of civil proceedings play the laws on the administration of
justice, in particular 1985, as well as the rules of the Supreme court and the rules of other courts,
which are being developed that are created for these committees, consisting of a small number of
judges and other highly qualified lawyers. These rules are approved by the Lord Chancellor (he
is directly heads the Committee on the rules of the Supreme court) and shall come into force, if
their projects do not meet the objections of the Parliament.

king’s bench (is headed by the Lord chief justice), clerical (chaired by the ViceChancellor), for
family Affairs (headed by the Chairman of the Department). Distribution of cases between the
offices is determined by specialization of the judges and the peculiarities of the procedure; in has

court. Judges are appointed from among lawyers. The case, filed in the first instance, consider
one judge. The separation of the king’s bench have jurisdiction over the case regulated by the
rules of General, commercial law. The complaints against the decisions of the high court are
served in the court of Appeal. It consists of 18 judges, referred to as the Lord and chaired by
custodian of the judicial archives. Proceeding of a panel of three judges. One of the Collegium of
the court deals only criminal cases. It is criminal division of the court of Appeal. In contrast to

The crown is the new creation, created by the Acts of the court of 1971. He considers the
criminal proceedings. Its composition is diverse. Depending on the type of crime the case may
consider any judge of the High court or a district judge, or рикордер (barrister or solicitor, acting
judge). If the accused pleads not guilty, the case involved the jury. Decision of the court of
Appeal may be appealed to the Appellate Committee of the house of lords (in some cases it was
possible direct appeal against decisions of the High court). Such appeal is exceptional: the house
of lords makes no more than 3040 decisions a year. The cases are examined by a minimum of
three lords on appeal. Every individual expresses his opinion on the case. The judges of the
house of lords as such or in conjunction with the judges of the overseas territories form the
Judicial Committee of the Privy Council. At this level, examines complaints on the decisions of
the Supreme courts of the overseas territories and States members of the Commonwealth, since
these countries do not exclude the possibility of filing such a complaint.
In addition to the high courts in England are a variety of lowerinstance court, which shall
consider about 90% of all cases. The most important of the lower courts in civil cases this is by
County courts. They deal with the amount in dispute is up to 1000 GBP. Minor works (the price
of the claim is less than 11 GBP.) can be considered assistant judge. Minor criminal cases under
the jurisdiction of magistrates ordinary citizens, to which is assigned the role of justices of the
peace. Their total number is about 20,000, it’s not professional lawyers, they do not receive
remuneration.

My Future Profession Is a Lawyer |
There are a lot of questionable situations that we can get stuck in in our life. If we are talking about the restoring of justice and the protection of human rights or legal rights in court of law then lawyers are the ones who help us. |
A lawyer is one of the oldest professions that was first known in ancient Rome which means it is very important. People who had special knowledge and were able to argue and prove their point of view were always needed in the society. Nothing has changed nowadays. |
Lawyers are still in high demand and their profession is very prestigious and high-paying. People go to lawyers in order to solve a lot of different problems such as problems with administration, taxes, property, civil rights etc. д. |
Lawyers spend a lot of time doing a routine job, comparing facts, organizing all their papers. It is very hard because you can make a mistake or miss some details and it will have negative impact on clients. |
Generally speaking, lawyers’ job is very difficult and high-demanding. It requires you to know not only the laws of our country but also be able to set up a defense line in court which will help you to win even a very complicated case. |
I know all that but I really want to help people that are protected by the law and I feel like I can work in legal environment. More than that I feel that it is my calling because not everyone knows his rights and often the justice depends on their lawyers. If I have to do a lot of work and collect many different documents and evidence in order to prove they are right then I’m willing to do it.

My Future Profession as a Lawyer |
All the people interact with the law during their life. At first, every key event in one’s destiny must be fixed in legal documents: birth certificate confirms the childbirth, marriage certificate – the family creation, employment record shows the profession and work experience… Besides, a large purchase (for example, of a house or a car) demands a special contract or a license. |
Sometimes, only a specialist of jurisprudence can resolve problems tied with legal documents. A tourist goes to a legal counsel if there is something wrong with his insurance policy; a businessman asks for a legal advice to make a trade agreement more efficient; a person wanting to compose a will must use a notary’s services. Therefore, people need lawyers constantly, in their everyday life. |
However, I study at the faculty of law to become an attorney and to work in court. Law is significant not only as a system of documents but also as a regulator of social life preserving ethical norms. Local, state and international laws exist to establish and protect human rights, especially if a person suffers from an offense or a crime. In this situation, the court determines a right and a guilty and appoint punishment in accordance with the guilt – a fine, administrative arrest, or even imprisonment. |
My dream is to protect human rights in the criminal law: in theft, fraud, murder trials. An attorney should carefully examine the case, the testimony of witnesses and the accused’s personality to achieve justice and avoid a judicial error. Of course, this work is extremely serious and responsible, but important like nothing else. |
